1. Introduction
Welcome to Trippix ("we," "us," or "our"). Trippix is operated by [Company Name], registered in the Netherlands under Chamber of Commerce (KVK) number [Insert KVK Number], located at [Insert Address].
By accessing or using our AI-powered travel curation service at trippix.travel (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our Service.
2. Nature of Services
Trippix is an AI-based travel inspiration and planning tool. We are NOT a travel agency, tour operator, or "organiser" as defined in the EU Package Travel Directive (2015/2302).
We provide AI-generated itinerary suggestions, travel tips, and curated content. We do not sell flights, hotel accommodations, or package holidays. All bookings are made by you directly through third-party providers. By using our Service you acknowledge and accept this distinction.
3. AI Disclaimer & Accuracy of Information
3.1 No Guarantee of Accuracy
Our Service uses Google's Gemini Large Language Model (LLM) and other AI technologies to generate travel content. While we strive for quality, AI systems can produce inaccurate, outdated, or invented information ("hallucinations").
- You are solely responsible for verifying all information — including prices, opening times, visa requirements, health requirements, and transport schedules — before making any financial commitments.
- Trippix is not liable for outdated, incorrect, or non-existent attractions, routes, or prices suggested by the AI.
- AI-generated content does not constitute professional travel, legal, medical, or financial advice.
3.2 Pricing and Availability
Any prices or availability estimates shown are indicative only. Actual prices are determined by the relevant third-party provider at the time of booking.
4. User Accounts & Google Sign-In
To access certain features of the Service, you must create an account. You may register using Google Sign-In (OAuth 2.0), powered by Google LLC. By using Google Sign-In, you are also subject to Google's Terms of Service and Privacy Policy.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable Dutch or EU regulations.
- Scrape, copy, reproduce, or resell any content, itineraries, or data generated by the Service.
- Attempt to reverse-engineer, interfere with, or disrupt the Service or its underlying systems.
- Use the Service to transmit harmful, offensive, or fraudulent content.
- Create multiple accounts or use the Service via automated means without our prior written consent.
6. User Responsibilities
- Travel Documents: You are solely responsible for ensuring you hold valid passports, visas, and health documentation (vaccinations) required for your destination.
- Safety: You are responsible for reviewing travel advisories from your government (e.g., the Dutch Ministry of Foreign Affairs: www.nederlandwereldwijd.nl) before traveling.
- Third-Party Bookings: Any booking you make through a third-party provider is governed by that provider's terms and conditions. Trippix is not a party to such agreements.
7. Intellectual Property
The Trippix brand, logo, platform design, and curation methodology are protected by intellectual property rights. AI-generated itineraries produced through our Service may be used by you for personal, non-commercial purposes only.
You may not scrape, reproduce, distribute, or create derivative works based on our content or underlying data without our prior written consent.
8. Third-Party Links and Affiliate Disclosure
Our Service contains links to third-party websites and services.
- Affiliate Disclosure: We may earn a commission if you click an affiliate link and make a purchase. This does not affect the price you pay.
- No Control: We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites.
- Partner Services: We may integrate with third-party travel platforms (e.g., Booking.com, Skyscanner). Your use of those platforms is governed by their own terms.
9. Limitation of Liability
9.1 General Limitation
To the maximum extent permitted by Dutch law (Article 6:237 BW), Trippix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses arising from your use of the Service.
9.2 Direct Damages Cap
To the extent permitted by applicable law, our total liability for direct damages arising out of or relating to your use of the Service shall not exceed the total amounts you have paid to Trippix in the twelve (12) months immediately preceding the event giving rise to the claim. If you have not made any payment to us, our liability is limited to €10.00 (ten Euros).
9.3 Specific Exclusions
We are not liable for:
- Cancellations, delays, or quality issues relating to bookings made via third-party providers based on our suggestions.
- Personal injury, death, or property damage occurring during travel.
- Force Majeure events (pandemics, natural disasters, strikes, etc.).
- Service interruptions caused by third-party infrastructure providers (Google Cloud, Firebase).
9.4 Dutch Law Exception
Nothing in these Terms limits our liability for damages caused by our own intent ("opzet") or gross negligence ("bewuste roekeloosheid"), or for death or personal injury resulting from our negligence, as required by Dutch law.
10. Credits & Payments
Trippix operates on a credit-based system. Certain features of the Service require the purchase of credits ("Credits"), which are consumed when you use those features.
10.1 Purchasing Credits
- Credits are sold in pre-defined packages and priced in Euros (€).
- All credit purchases are processed securely via our payment provider. Payment is required upfront before Credits are added to your account.
- Credit packages are displayed with their current price on the Service. Prices are inclusive of any applicable VAT.
10.2 How Credits Work
- Credits are deducted from your account balance each time you use a Credit-consuming feature (e.g., generating an AI itinerary).
- Credits do not expire, unless otherwise stated at the time of purchase.
- Credits are non-transferable and linked to your individual Trippix account. They have no monetary value and cannot be traded or exchanged.
10.3 No Refund Policy
All credit purchases are final. We do not offer refunds on Credits, whether used or unused, except as required by applicable mandatory law (see Section 10.4 below).
Specifically:
- Partial Use: If you purchase a credit package and use even a single Credit, the entire package is considered consumed for refund purposes. No refund will be issued for remaining unused Credits in that package.
- Unused Credits: Even if you have not used any Credits, refunds are not guaranteed after the statutory withdrawal period has passed (see Section 10.4).
- Account Termination: If your account is suspended or terminated for violation of these Terms, you forfeit any remaining Credits without compensation.
10.4 EU Consumer Right of Withdrawal (Herroepingsrecht)
If you are a consumer located in the European Union or the Netherlands, you ordinarily have a statutory right to withdraw from a digital content purchase within 14 calendar days of the transaction, without giving a reason (EU Consumer Rights Directive 2011/83/EU; Burgerlijk Wetboek Book 6).
However, by completing a credit purchase on Trippix, you expressly request immediate access to the purchased Credits and acknowledge that:
- Once any Credit has been used (i.e., once the digital content has begun to be delivered), your right of withdrawal is lost in accordance with Art. 16(m) of the Consumer Rights Directive and Dutch implementing law.
- If you have not used any Credits, you may exercise your right of withdrawal within 14 days by contacting us at jeffrey@trippix.travel before any Credits are consumed.
10.5 Pricing Changes
We reserve the right to change the price of Credit packages at any time. Price changes will not affect Credits you have already purchased.
10.6 Subscriptions (Future)
We may introduce subscription plans in the future. Any subscription terms will be presented to you clearly at the time of purchase and will supplement or replace this section as applicable.
11. Termination
We reserve the right to suspend or terminate your account at our sole discretion, without notice, if we believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Service. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the exclusive jurisdiction of the competent court in Amsterdam, Netherlands.
For consumer disputes, you may also contact the Dutch Disputes Committee (Geschillencommissie) or the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
